What you'll deliver
1. A redesigned pack-opening sequence (build-up, burst, card landing, settle) as a Rive file with a state machine: inputs for card tier (bronze/silver/gold/diamond) and phase triggers, and a slot where our app places the real card image. Lottie is acceptable for effects layers if you don't work in Rive.
2. A short motion spec (durations, easing curves) for the three screen transitions that our developer will apply in code.

We are IslandGo Tours & Transportation (branded IslandCab), a multilingual airport transfer and tour operator based in Saint-Martin/Sint Maarten. We currently use a white-label dispatch SaaS (Cabcher) and want to move to our own custom platform, built in phases, starting with a lean MVP.

3. Client-Facing Booking Portal (Web + Hotel Kiosk Mode)

We will be placing tablet kiosks in partner hotels (locked-down enclosures, e.g. Armodilo Curve, iPad-based). From the hotel, a guest must be able to walk up and book directly — the same portal should work both as a normal website and as a simplified "kiosk mode" (larger buttons, no browser chrome, auto-return to home screen after booking/timeout).

The portal needs two distinct booking flows:

A. Point-to-point taxi booking: guest selects pickup (defaults to the hotel when booked from that hotel's kiosk) and picks ANY destination on the island — not a fixed list. Destination can be a free address/place search (Google Places autocomplete or similar) or a picker among known zones/landmarks, with the zone-based fare calculated automatically (Zone 1–4 + night surcharge rule).
B. Island tour booking: guest books one of our set island tour products (e.g. our "Island Tour" — half-day guided circuit, priced per person) directly from the same portal, choosing date/time and number of participants, without needing to know pickup/dropoff details (tour has a fixed itinerary and meeting point).

Both flows end in a shared checkout (Stripe, SumUp nice-to-have) and a booking confirmation sent by email/WhatsApp to the guest, plus the booking appearing instantly in the admin dispatch dashboard (for taxi bookings, ready for driver assignment; for tour bookings, added to the tour schedule).

Kiosk requirement: each kiosk/tablet should be tied to its hotel so the system knows which property a booking originated from (for pickup default and hotel-level reporting/commission tracking later).

Background and Purpose
The Company operates two mobile application builds: a production build and a separate beta build. Both run on iOS and Android. The beta build disables emergency dispatch, evidence export, and payment processing. The production build provides full functionality at official launch.
This SOW covers what the policy documents do not: the in-application disclosures, consent capture flows, notification copy, app store submission artifacts, and the specific points where in-application disclosure is not merely advisable but legally required. The central principle is that a contractual clause in the Terms is not adequate notice for a safety or privacy consequence that a user encounters in the moment. A user who activates SOS and does not get help because a feature was disabled needs to know that at the moment they press the button, not on page 14 of a contract they accepted at enrolment.
Three specific flows require in-app disclosure independent of the Terms, and the attorney should give particular attention to each.
First, TCPA prior express written consent. Our current acceptance interface describes accepting "safety notifications" rather than presenting an explicit consent statement for SMS messages. We believe this is insufficient. Prior express written consent to receive text messages must be specific to the receipt of text messages, must disclose that standard message and data rates may apply, must not condition consent on a purchase, and must be clearly and conspicuously presented. We are asking the attorney to confirm this and to specify the precise interface language required.
Second, the free-tier storage limitation. On the Essential plan, evidence is stored on the user's device only and is not uploaded to or retained by the Company. This means that if the user's device is lost, stolen, damaged, reset, or seized, the evidence is permanently unrecoverable. This applies to all evidence, including evidence captured during an SOS activation. We believe a contractual provision in the Terms is insufficient notice for a safety consequence of this magnitude, and that the interface must surface this disclosure at tier selection and at a storage warning. We want confirmation and guidance on the specific placement and content required.
Third, recording-consent acknowledgment. Before audio capture is enabled, the user is presented with an acknowledgment screen showing voice detection status, jurisdiction, compliance profile, recording notice status, compliance-step progression, and action buttons including Acknowledge and Enable Audio, Continue Video Only, Call 911, SOS, and Stop Session. A three-second delay prevents the continue option from being selected immediately. We believe this is a strong consent capture mechanism. We want confirmation that it is legally adequate to establish consent, and we want to know whether the three-second delay is helpful, neutral, or creates a problem.

Group A — Consent Capture
These questions are the core of this SOW. Consent failures in these flows are the likeliest source of regulatory enforcement or class action exposure.
1. Recording consent — the compliance popup. When the on-device Voice Activity Detection model identifies that a second speaker may be present, the application presents a compliance popup before audio is enabled. The popup shows: the detection status and confidence level; the user's current jurisdiction and the applicable compliance profile (Profile A one-party, Profile B all-party or legally sufficient notice with an audio fail-safe, or Profile C heightened); the recording notice status; a compliance-step progression indicator; and five action buttons — Acknowledge and Enable Audio, Continue Video Only, Call 911, SOS, and Stop Session. A three-second delay prevents the Continue option from being selected before the disclosure has had time to be read. Two separate compliance records are created: one for playback and one for the acknowledgment event. Is this flow adequate to establish legally sufficient consent or notice for audio capture in all-party and one-party states? Does the three-second delay help, hurt, or have no legal effect?
2. SMS consent — the TCPA gap. Our current acceptance interface describes accepting "safety notifications." We believe this does not constitute TCPA prior express written consent to receive text messages. Please confirm, and specify precisely what the interface must present — the exact language, the placement relative to the acceptance button, and what records must be created and retained — to constitute valid prior express written consent for the three categories of SMS we send: transactional notifications, one-time passcode messages, and Safety Alert SMS to Emergency Contacts.
3. Terms assent. Is the in-app assent mechanism — the clickwrap or presented terms flow at account creation — sufficient to bind users to the Terms of Use, Privacy Policy, and SMS Messaging Policy?
4. Emergency Contact SMS enrollment. Our Emergency Contact enrollment uses email plus a one-time code plus affirmative acceptance. An Emergency Contact must affirmatively accept before any Safety Alert SMS is sent to their number. We do not send an automated platform invitation SMS. Is this enrollment flow adequate to establish TCPA prior express written consent for the Emergency Contact — who is a separate party from the account holder — to receive Safety Alert SMS?
5. Third-party data capture. The Post-Incident Evidence Wizard allows the user to capture another person's driver's licence and insurance information. That person has no account with us and has not consented to data collection. What must the interface present to the capturing user — at the point of capture — to adequately disclose that the user is collecting another person's personal data and is responsible for having any legal basis required? Is a Terms provision sufficient, or does in-app disclosure at the capture screen add meaningful protection?
Group B — Safety Disclosures
These are the disclosures where a clause in the Terms is legally insufficient and in-app disclosure is required.
6. Free-tier storage limitation. On the Essential plan, evidence is stored on the user's device only and is not uploaded to the Company. If the device is lost, damaged, reset, or seized, all evidence — including SOS evidence — is permanently unrecoverable. We believe this must be disclosed in the interface at the point of tier selection and at the storage warning, not only in the Terms. Please confirm that a Terms provision alone is inadequate, and specify what the interface must say, at which screens, and with what prominence.
7. Timer expiry. Safe Walk and Safe Trip sessions use device-local timers only. There is no server-side monitoring and no automatic notification sent to any person when a timer expires without a response. Does any screen, notification, push message, onboarding card, or tooltip in either build imply that someone will be notified? If so, those strings must be identified as must-fix findings.
8. Beta emergency dispatch disclosure. The beta build displays a notice stating that emergency dispatch is paused, that the native 911 dialer remains available, and that the user should not rely on the product as a sole means of emergency communication. Is that in-app disclosure adequate given that a user may be in an actual emergency while using the beta?
9. Push notification copy. Does any push notification sent by either build imply that help has been summoned, that a contact has been notified, or that an emergency response is in progress, when those things have not occurred? Push notifications are often written separately from screen copy and are frequently not reviewed in a legal context. Please review all push templates as part of this engagement.
Group C — App Store Submission Artifacts
These artifacts are frequently completed once and never revisited. A mismatch between the App Store privacy manifest and the Privacy Policy is a straightforward finding for an App Review or a regulator.
10. Does the Apple privacy manifest declare all bundled third-party SDK categories present in the application? The SDK inventory describes components by function — background location, crash and error reporting, mapping, push notification, on-device voice activity detection, media compression, real-time communication, and framework libraries. Does the manifest cover each category?
11. Do the Apple App Privacy details and the Google Play Data Safety form match what the Privacy Policy states is collected, used, and shared? Identify any discrepancy.
12. Subscription purchases occur on our website, not within the application. On iOS, we rely on the external link and reader app provisions of the App Store guidelines as updated May 1, 2025 following the Epic v. Apple judgment. On Android, we follow comparable Google Play provisions. Does this model comply with current app store rules for US-storefront users, and does the in-app disclosure at §9.13 adequately address users in international markets where external purchase rights differ?
13. Is the application's age rating on each platform consistent with our stated eligibility requirement of 18 years of age or older for account holders, and with the presence of Family plan secondary members who may be minors?
Group D — Cross-Reference
14. Review the in-app strings, notification templates, onboarding flows, and settings screens across both builds and identify any claim, representation, or disclosure that is inconsistent with the policy documents.

Background and Purpose
The Company is a limited liability company building a personal safety and forensic evidence documentation platform for the United States market. The product is a mobile application — available on iOS and Android — that allows users to monitor their own safety during daily activities. It records audio and video evidence during user-initiated sessions, stores that evidence in an encrypted Evidence Vault, and provides tools to share that evidence with law enforcement, licensed attorneys, licensed private investigators, and trusted personal contacts.
The platform applies an automated, 51-jurisdiction Compliance Decision Engine that detects the user's location by GPS and applies the applicable state recording-consent rules. In all-party consent states — including California, Maryland, Florida, Illinois, and Pennsylvania — the engine disables audio capture and provides a video-only fallback unless the conditions for lawful recording are met. Voice Activity Detection, an on-device probabilistic model, identifies whether a second speaker is present and surfaces an acknowledgment flow before audio is enabled.
Two sequential releases are planned. A limited public beta launches first with emergency dispatch and evidence export disabled. The official launch follows with full functionality. Both releases are governed by separate sets of five policy documents. The two sets share approximately 90% of their content. This is a targeted legal review, not a drafting engagement. The documents have been drafted. The attorney is asked to identify provisions that will not be enforceable, provisions that create unanticipated exposure, and answers to the specific questions listed under each milestone — with a clear enforceability determination and a section reference for every finding.
Why This Product's Risk Profile Is Unusual
The attorney should understand four specific risks before reviewing.
First: product liability for safety failures. Courts apply heightened scrutiny to liability disclaimers where a user may have relied on a safety function and suffered physical harm. The leading case law — Monitronics v. Veasley, Spengler v. ADT, Valenzuela v. ADT — establishes that a token cap against a foreseeable death or injury claim will not hold, and that an exculpatory clause purporting to release gross negligence is void under California Civil Code §1668. We believe our cap and carve-out structure is sound. We want confirmation.
Second: third-party capture. Users may record conversations involving people who have not consented to the product. State recording-consent statutes — including felony wiretapping provisions in Pennsylvania, Florida, and Maryland — impose criminal and civil liability on the person recording. Group B — Automatic Preservation and Deletion Rights

6. Every SOS activation automatically creates a preservation record that prevents archival and purge indefinitely, without any underlying litigation, subpoena, or other legal obligation. We propose to call this "Emergency Preservation" rather than "Legal Hold." Does applying the automatic preservation flag survive as an exemption to statutory deletion rights under CCPA/CPRA §1798.105, VCDPA §59.1-578, CPA §6-1-1306, and TDPSA §541.054? Does calling it Emergency Preservation rather than Legal Hold change the analysis?
7. We do not offer a self-serve per-file delete function. We process verified deletion requests and identify which of five enumerated exceptions applies to each record we decline to delete: immutable WORM storage, emergency preservation, legal hold, a legal retention obligation, or an active fraud or security investigation. Is storage-quota evasion a permissible basis for declining deletion under any of those four statutes?
8. Evidence on a lapsed paid account becomes archived and inaccessible after day 60. Restoring in-application access requires a paid pass. Verified statutory access and portability requests are fulfilled free regardless of archive state. Group C — Recording Consent
9. §11.3 allocates compliance with state recording-consent law to the user. Our compliance engine, Voice Activity Detection, jurisdiction detection, and audio fail-safe are described as assistive tools only — probabilistic, not constituting legal advice, and not determining that any particular recording is lawful. Is this allocation effective, and does it prevent the engine from being characterized as an implied warranty of lawfulness?
10. If the Voice Activity Detection model fails to detect a second speaker in an all-party state and the user records without consent, what is our exposure? Does the assistive-tool language adequately transfer that risk?
Group D — Minor Users and COPPA
11. Minors do not hold independent accounts. A minor participates only as a secondary member added to a Family plan by an adult primary account holder. Beta is 18+ only. In the official launch, a parent adds a minor child; the parent does not go through a verifiable parental consent flow because the parent is the account holder. Does this primary-account-holder model satisfy verifiable parental consent by design under the amended COPPA Rule (16 C.F.R. Part 312, effective April 22, 2026), or is separate VPC still required for the minor?
Group E — Governing Law, Cessation, and Beta-Specific
12. §19.1 selects the governing law stated in the Terms with non-exclusive consumer venue. Is this appropriate and defensible against a consumer arguing their home state's anti-waiver, wiretapping, or privacy statutes should apply?
13. The cessation-of-business provision at §13.5 scopes each retention period as a description of handling while operating, commits to 30 days' notice and an export window where practicable, and refunds prepaid amounts pro rata. An existing, battle-tested codebase is essential; I’m not interested in commissioning a brand-new build from scratch. I’ll need:

• Demo access or video walkthrough to verify all the above features in action
• Source code rights or a clear white-label licence allowing me to rebrand and publish under my own accounts in both Google Play and Apple App Store
• Documentation for deployment, configuration, and future maintenance
• Post-handover support for at least one month to fix any integration issues

If your solution is built with React Native, Flutter, Kotlin/Swift, or another cross-platform framework, let me know; that will help me plan internal maintenance. Please confirm which stores it is currently live in (if any), the minimum OS versions supported, and any third-party services or APIs (e.g., Firebase, Map SDKs) that the app relies on.
